The Paulist Republic, officially known as The Most Serene Paulist Republic, is a sovereign nation in South America, emerging from the historical and economic powerhouse of Brazil’s former São Paulo state. The grandsons and granddaughters of the brave heroes of the 1932's constitutionalist revolution rejoice, the separation from the corrupt socialist juristocracy known as Brazil is a new beginning for the hardworking people of São Paulo. Established following a successful bid for independence and political maneuver, the newly formed republic is a dynamic blend of industrial might, financial prowess, and deep cultural heritage, positioning itself as one of Latin America’s leading economies.

Spanning from the Atlantic coast to the rolling highlands of the interior, the Paulist Republic enjoys a diverse landscape that supports both thriving urban centers and vast agricultural regions. The capital, São Paulo City, remains the beating heart of the nation, housing the government and acting as the primary economic hub. With a population of over 45 million, the republic boasts a highly urbanized and technologically advanced society, characterized by a robust middle class and a globally connected workforce.

The Leadership status of High Commander is a reminder of São Paulo's independence and vigilance amidst the ever looming presence of the Socialist Brazilian enemy.

The Constitution of The Most Serene Paulist Republic

We, the people of São Paulo, in order to establish justice, secure freedom & liberty, and ensure the prosperity of our nation, do hereby enact and establish this Constitution as the supreme law of the land and basic jurisdiction for all agreements and social relations between paulistan brothers and sisters.

Any changes to this Constitution shall be made through nationwide plebiscite.

ARTICLE I – NATURAL RIGHTS

1)      Right to Life - The right to life shall be protected under the Non-Aggression Principle. No person shall be deprived of life except in the defense of oneself or others against unlawful aggression.

2)      Right to Self-Defense - All individuals, as sovereign beings, possess the inalienable right to defend themselves, their families, and their property against acts of aggression.

3)      Right to Property - The right to acquire, own, and dispose of property is fundamental to individual liberty. No person shall be arbitrarily deprived of property, and all property rights shall be protected under the law.

ARTICLE II – CIVIL LIBERTIES

1)      Freedom of Speech and Expression - All citizens shall have the unrestricted right to freedom of speech, expression, and the press. No law shall be enacted that infringes upon these rights.

2)      Freedom of Religion - The government shall endorse Christianity but shall not compel its practice nor restrict the religious freedoms of any individual, except in governmental activities, ceremonies and rites.

a.      The government shall recognize and incorporate Christian elements in its official rites, ceremonies, and traditions, reflecting the nation's historical and cultural heritage.

b.      No other religious traditions shall be incorporated into government functions, and state institutions shall not promote or accommodate the practices of any faith other than Christianity.

c.      No law or decree shall compel any citizen to adhere to Christianity, nor shall any religious test be required for holding public office or military function.

d.      Elected officials and government representatives shall not impose religious beliefs upon their colleagues or subordinates, nor shall they be required to participate in religious practices as a condition of service.

3)      Right to Marriage - Marriage shall be recognized as a legal union between two consenting adults.

4)      Citizen Integrity

a.      Capital Punishment – No person shall be subjected to capital punishment under any circumstances.

b.      Inquiries created by the Jucidiary branch will not exceed 18 months, at which point, files will be declassified and sent to a special commission in the lower house of Congress for evaluation.

c.      Torture – The government shall neither engage in nor permit the torture of any individual.

d.      Assisted Suicide – The practice of assisted suicide is strictly prohibited and punishable by life in prison.

e.      Abortion – The termination of unborn life is unlawful in all circumstances.

ARTICLE III – GOVERNANCE AND PUBLIC POLICY

1)      Government Taxation and Expenditure – Public accounting will be handled ONLY by Congress, the legislative house will have total control over budgetary law, and all spending is subject to Congressional approval.

a.      The government shall maintain a balanced budget and shall not engage in déficit spending. If GDP/Debt relation reaches 95%, all government activities shall cease, Congress will be summoned to hold an emergency meeting, in which the following will occur:

           i.      Immediate suspension of Congressmen and High Commander salaries until superávit is achieved.

          ii.      Establishment of Special Committee for Expenditures Containment (SCEC), which can be formed beforehand and will perform the following measures (including additional enactments to reduce spending without limitations):

              1.      Lay off or termination of public workers.

              2.      Auction government property.

              3.      Privatize infrastructure and public services, locally or nationwide, including, and not limited to, military and police.

            iii.      Taxation is limited to a single, uniform rate applicable to all citizens’ income. Any change in taxation must be done through nationwide plebiscite.

2)      Campaign Finance - The government shall have no authority to regulate how individuals or organizations allocate their financial resources in political matters. There shall be no public funding for political parties.

3)      Welfare and Social Assistance - Government assistance shall only be available to individuals in poverty who engage in community service. Welfare and Social assistance of any kind do not extend to immigrants or their descendants before the fifth generation.

ARTICLE IV – LABOR AND EDUCATION

1)      Right to Work and Unionization – The government will not interfere in work relations.

a.      Work contracts are defined only by employer and employee

b.      Unions are allowed to exist exclusively through employee funding, affiliation is voluntary

c.      Employers shall retain the right to terminate employees who attempt to organize or participate in labor unions.

2)      Education Policy - The government shall not subsidize, regulate, or finance any aspects of education.

a.      There shall be no regulatory entity for education

b.      There shall be no financial assistance for education

c.      Any educational endeavour originating from the government must bring no financial déficit for the budget and must be created as an alternative to existing private educational options available

ARTICLE V – DEFENSE AND PUBLIC SAFETY

1)      Military - Military shall be encouraged but shall remain voluntary for all citizens.

a.      The High Commander is the Executive Chief of the Military, all decisions are made through the Legislative branch.

b.      Our nation Military is the most important entity and shall take priority in the budget.

c.      Leaders of the high positions of the 3 branches are to be appointed only by the High Commander and can be terminated at any time without notice or warning.

d.      The military can be composed of private companies to a limit of 30% to 50% manpower in each of the 3 branches, after consulting Congress.

2)      Civil Service - Community service shall be encouraged but shall remain voluntary for all citizens.

a.      There shall be only the Military Police, privatization limited to 60%, limit can be revised by Congress.

b.      Fire Department can be fully privatized.

c.      Medical responders can be fully privatized.

3)      Right to Bear Arms - The right of the people to keep and bear arms shall not be infringed. Citizens shall have the right to own, possess, and carry any weapon of their choosing.

a.      The punishment for negative externalities generated by the misuse of arms will be accentuated according to their extension.

ARTICLE VI – PUBLIC HEALTH AND MORALITY

1)      Healthcare - The government shall not regulate, interfere with, or provide healthcare services.

2)      Drug, Alcohol and Mental Faculties Altering Substances Policy - The possession, consumption, distribution, and sale of beforementioned products shall be lawful for adults.

a.      The recreational use of (substances commonly known as) drugs and alcohol shall be permitted for individuals over the age of eighteen. The recreational use of drugs and alcohol shall not be deemed unlawful.

3)      Family, Inheritance and Marital Laws – A family is composed of an adult man and an adult woman and their child, or children.

a.      Polygamous marriage shall be prohibited; only unions between two individuals shall be legally recognized.

b.      Marrying an underage is strictly forbidden and punishable by losing citizenship.

c.      Parents shall retain the right to circumcise their infant sons if they are jewish.

d.      Inheritance is a right of the parents

                  i.      Taxation on inheritance is forbidden

                  ii.      Parents must register legal detail for inheritance in public or private court.

                  iii.      Parents decide how inheritance is passed on, if they fail to register legal details for inheritance distribution the entirety will be equally distributed between the child, or children, if there is, or aren’t, any, it will be equally distributed according to family relational proximity, if there isn’t, or aren’t, any family able to receive it, it will be passed on to Congress to be spent on debt.

ARTICLE VII – IMMIGRATION AND NATIONAL POLICY

1)      Immigration Control - The government shall regulate immigration through the establishment of fixed quotas on the number of foreign nationals permitted to enter the country. The quotas must be established by Congress.

2)      Energy Policy - The government shall support oil and coal as the primary energy sources of the nation without detriment to other energy sources. Concerns regarding environmental pollution shall not override national energy priorities.

a.      The cost/efficiency relation is a priority upon choosing energy sources

b.      Energy Generation can be privatized

ARTICLE VIII – LAW SUPREMACY AND GOVERNMENT BODY

1)      Supremacy Clause - This Constitution shall be the supreme law of the land. This lawful framework is the minimum judicial basis for our societal harmony. Any laws, regulations, or governmental actions that contradict its provisions shall be null and void.

2)      Amendment Process - Amendments are forbidden.

3)      Judiciary Branch – The Judiciary Branch is composed by 3 Tiers, judges can be impeached by congress, impeachment petitions can be made by any citizen or public officer.

a.      Hierarchy – 3 spheres composed of:

                 i.      Supreme Court: 3 Judges, 15-year term.

                 ii.      Regional Courts: 5 Regions, 5 judges per regional court, judges serve 10-year term.

                 iii.      Local Courts: 5 judges per municipality, judges serve 10-year term.

b.      Impeachment petitions - Subject to the Congress leader, who is obligated to pass it to vote session within 3 months without delay, impeachment must reach two/thirds of the lower house to be submitted to the Senate’s Leader who shall put it to voting session within 1 week, impeachment will be successful with two/thirds of the Senate vote.

c.      The Judiciary system can delegate non-constitutional matters in lower and middle spheres of hierarchy to private courts (arbitration).

4)      Legislative Branch – The body of our nation that shall be responsible for lawmaking and budget definition.

a.      Parliamentary Immunity – All Congressmen have parliamentary immunity during term.

b.      Lower House – Representatives of the State are responsible for proposing new laws and proposing budgetary laws and are to be formed by the following manner:

                   i.      55 is the maximum number of representatives, to be divided between the 11 mesoregions of São Paulo, ranging from 1 to 5 by region according to the contribution of GDP and Population Census of each region.

                   ii.      5-year term.

                   iii.      The Census shall occur every 10 years and will give a score based on GDP contribution and Population.

1.      GDP contribution to the score is 70%.

2.      Population contribution to the score is 30%.

                     iv.      All Representatives are demanded to participate in Budget Commission meetings that occur quarterly, failing to do so will result in immediate impeachment.

1.      Budget Commission Meetings must occur at the beginning of each quarter and extend throughout the week.

2.      All matters related to it shall be immediately released to the public.

c.      Upper House – Senators are responsible for passing or rejecting Lower House law proposals and budget laws and are to be formed by the following manner:

                      i.      33 is the maximum number of senators, to be divided between the 11 mesoregions of São Paulo, ranging from 1 to 3 by region according to the beforementioned Census.

                       ii.      10-year term.

5)      Executive Branch – Responsible for executing the laws and following budgetary restrictions laid by Congress. The High Commander is the leadership position in the Executive branch of our nation.

a.      5-year term.

b.      Power to execute laws and budget.

c.      Control over Military and Civil Service to the limit of law.

d.      Can create Executive Orders that are valid upon signing.

     i.      Must be submitted to Congress for invalidation.

This Constitution, having been duly considered and ratified by the People of São Paulo, shall enter into force upon its formal adoption, God bless our Most Serene Republic.
