Constitution of the United Democratic States

 

Preamble

We, the citizens of the United Democratic States, in recognition of the paramount importance of informed governance and collective well-being, hereby establish this Constitution. We are committed to ensuring that the governance of our nation is carried out by those who have demonstrated the greatest understanding of our society’s needs and functions. We seek a government that is both participatory and informed, where all citizens have the opportunity to contribute to the welfare of the nation through a system that encourages responsible and knowledgeable leadership.


Article I: The Structure of Government

The government of the United Democratic State shall consist of three branches: the Legislative Branch, the Executive Branch, and the Judiciary Branch. These branches shall function in accordance with the principles of informed democracy, with a bicameral legislature composed of the General Assembly and the Senate, as well as an Executive Branch led by a chamber of state Governors, and an independent judiciary.

 

Section 1: The Congress

The Congress shall be bicameral, composed of a General Assembly and a Senate.

General Assembly

1)     Composition
The General Assembly shall consist of 1,000 randomly selected citizens, chosen according to the eligibility criteria defined below.

2)   Eligibility
a. Must be at least 26 years old.
b. Must be a citizen of the United Democratic States
c. Must have attained Tier 2 voter status, as determined by the Informed Plural Voting System.
d. Can serve a 2-year term, with no more than 3 non-consecutive term.

3)    Powers and Duties
a. The General Assembly has the sole authority to create, alter, amend, or otherwise change statutory laws.
b. The General Assembly has the responsibility to set federal budget deficit limits annually, based on requests from the Executive.
c. The General Assembly has final authority on funding requirements, including those related to laws, national defense, and warfare.
d. Laws can originate in either the General Assembly or the Senate, but must pass both chambers before proceeding.

Senate

  1. Composition
    The Senate shall consist of 3 senators per state, regardless of population size.
  2. Eligibility
    a. Must be at least 35 years old.
    b. Must be a citizen of the United Democratic States.
    c. Must have attained Tier 3 voter status, as determined by the Informed Plural Voting System.
    d. Senators must be elected by popular vote in their respective states using the Informed Plural Voting System.
    e. Senators may serve 6-year terms, with a maximum of 5 cumulative terms.
  3. Powers and Duties
    a. The Senate is responsible for ratifying laws passed by the General Assembly.
    b. The Senate holds the authority to confirm or reject executive nominations and ratify international treaties.
    c. The Senate has the responsibility to oversee federal budget planning and approve or reject the annual funding requests of the Executive.

Section 2: The Executive Branch

The Executive Branch shall be led by The Chamber of Governors, with each state's Governor serving as a co-equal executive of the federal government.

  1. Composition of the Executive Branch
    The Executive shall be a collective body of state Governors, each responsible for their respective state's governmental affairs. The Governor of the Capital shall serve as the Chief Governor, presiding over the Chamber of Governors.
  2. Eligibility for Governorship
    a. Must be at least 30 years old.
    b. Must be a natural-born citizen of the United Democratic States.
    c. Must have attained Tier 3 voter status.
    d. Must be elected by the Informed Plural Voting System, through a statewide popular vote.
    e. Governors must be faithful to the nation’s laws and uphold the principles of the Constitution.
  3. Powers and Duties
    a. The Executive Branch is responsible for executing the laws of the nation, carrying out foreign and domestic policy goals, by The Congress and national policy interests, respectively.
    b. The Executive oversees the administration of federal programs and the execution of regulations, ensuring they align with statutory law.
    c. The Executive is the Commander in Chief of the Armed Forces, responsible for national defense and military oversight.
    d. The Executive may veto laws passed by the Legislature, but such vetoes can be overridden by a supermajority vote in both chambers.
  4. Departments and Nominations
    a. Each Governor will be assigned to a federal department(s), based on their expertise, as determined through a nomocratic process.

Section 3: The Judiciary Branch

  1. Composition
    The Judiciary shall be composed of 5 Justices appointed to the highest court of the land, the Supreme Court of the United Democratic States.
  2. Eligibility
    a. Justices must be at least 35 years old.
    b. Justices must have served in a lower court for a minimum of 5 years.
    c. Justices must have attained Tier 3 voter status.
    d. Justices must be citizens of the United Democratic States.
  3. Powers and Duties
    a. The Judiciary holds the authority to interpret the Constitution and review the constitutionality of laws.
    b. The Judiciary may also hear legal disputes and ensure that justice is delivered in accordance with the Constitution.

Article II: Constitutional Amendments

  1. Amendment Proposal
    Amendments to this Constitution may be proposed by either the General Assembly or the Senate, provided that the proposal is supported by a supermajority (70%) vote in the respective body.
  2. Amendment Approval Process
    a. The amendment must pass Judicial Review with a majority vote.
    b. The amendment must pass the Executive branch with a majority vote.
    c. The amendment will then be put to a vote by all eligible voters, and will be considered ratified if it achieves a simple majority vote.

Article III: The Informed Plural Voting System

  1. Overview
    The Informed Plural Voting System (IPVS) ensures that voting is based on an informed electorate. All citizens are required to demonstrate a level of knowledge about the governance and functioning of the nation, as well as broader issues like economics, science, and global politics, before being granted voting rights.
  2. Eligibility for Voting
    All citizens who are 18 years or older, have completed secondary education, and retain the capacity to vote, are eligible to participate in elections.
  3. Tiered Voting
    a. Tier 1: Citizens with a score of 0-24, receiving 1 vote.
    b. Tier 2: Citizens with a score between 25 and 39, receiving 2 weighted votes.
    c. Tier 3: Citizens with a score above 39, receiving 3 weighted votes.
  4. Voting Process
    All elections shall be conducted through Ranked Choice Voting, where voters rank their choices, and ballots are redistributed until a winner is determined. Plural voting ensures that citizens with higher tiers of knowledge are given greater influence in the election process.

We, the citizens of the United Democratic States, in solemn affirmation of our belief in an informed, responsible, and participatory system of governance, adopt this Constitution to guide the workings of our nation. Through our collective commitment to knowledge and justice, we shall build a more prosperous and fair society for future generations.
