PREAMBLE

We, the people of the Most Serene and Holy Empire of Elysia in recognition of our historical heritage, cultural diversity, and the desire for a just and harmonious society, hereby establish and promulgate this Constitution for the common good and well-being of our citizens.

 

ARTICLE I: NATIONAL TERRITORY

The national territory of the Holy Elysian Empire includes its lands, waters, and airspace as defined by law.

 

ARTICLE II: DECLARATION OF PRINCIPLES AND STATE POLICIES

Section 1. The Holy Elysian Empire is a Semi-Constitutional Monarchy.
Section 2. The state upholds democracy, justice, equality, respect for human rights, and a commitment to friendly relations with all nations.
Section 4. Civilian authority supersedes military authority.
Section 5. There is a separation of church and state.
Section 6. The state pursues an independent foreign policy.
Section 7. Nuclear weaponry is abolished.
Section 8. The family is the basic unit of the state.
Section 9. The role of youth and women in nation-building is promoted.
Section 10. Local governments enjoy autonomy.
Section 11. Equal opportunity and the prohibition of political dynasties are ensured.
Section 12. The protection and advancement of the right to a balanced and healthful ecology are paramount.


ARTICLE III: BILL OF RIGHTS

Section 1. Citizens have the right to life, liberty, and security.
Section 2. Privacy is inviolable, and searches require judicial warrants.
Section 3. Freedom of speech, expression, and peaceful assembly is protected.
Section 4. The right to bear arms is regulated by law.
Section 5. Access to information is a right, with limitations for national security.
Section 6. Abortion is permitted in cases of !@#$, !@#$, or risk to the pregnant person's life.


ARTICLE IV: CITIZENSHIP

Section 1. Citizenship is granted based on criteria defined by law.
Section 2. It may be acquired by birth, descent, naturalization, or other means as prescribed by law.
Section 3. Birth within the territory confers citizenship, unless stated otherwise by law.
Section 4. Citizenship by descent is granted with specified conditions.
Section 5. Citizenship by naturalization requires good moral character, residency, language proficiency, and allegiance.
Section 6. Parliament has authority over citizenship laws.
Section 7. Dual citizenship may be allowed under conditions set by law.
Section 8. Citizen rights and obligations are protected and regulated by law.


ARTICLE V: SUFFRAGE

Section 1. Suffrage is a right and duty exercised by citizens.
Section 2. Every citizen of majority age has the right to vote.
Section 3. Voting is mandatory, with penalties for non-compliance.
Section 4. Civic education promotes awareness of suffrage.
Section 5. Exceptions to mandatory voting may be allowed for valid reasons.
Section 6. Enforcement respects citizens' rights and dignity.


ARTICLE VI: GOVERNMENT STRUCTURE

The Holy Elysian Empire has a parliamentary system with the Imperial Senate as the Upper House and the House of Representatives as the Lower House.

 

ARTICLE VII: POWER OF MONARCHY

Section 1. The Monarch is the ceremonial head, with constitutional and symbolic powers.
Section 2. Powers are exercised within defined limits.
Section 3. The Monarch may dissolve Parliament and force the Prime Minister's resignation under exceptional circumstances.


ARTICLE VIII: SUCCESSION OF THE MONARCH

Section 1. Succession follows primogeniture rules.
Section 2. In the absence of a direct heir, the Monarch may designate a successor with parliamentary approval.


ARTICLE IX: IMPEACHMENT OF THE MONARCH

Impeachment may occur for grave offenses determined by referendum.

 

ARTICLE X: POWER OF LEGISLATIVE BODY

Parliament has the power to enact laws, respecting the Constitution and the will of the people.

 

ARTICLE XI: POWER OF THE JUDICIARY

Section 1. The judiciary is independent and interprets and upholds laws.
Section 2. Judges are appointed by the Monarch upon the Judicial Appointments Commission's recommendation.


ARTICLE XII: POWER OF THE PRIME MINISTER

The Prime Minister is the head of government, responsible for policy implementation and administration.

 

ARTICLE XIII: CONSTITUTIONAL COMMISSION

Section 1. A Constitutional Commission ensures constitutional integrity and good governance.
Section 2. Comprising the Electoral Commission, Human Rights Commission, and Commission on Audit.
Section 3. Members are appointed by the Monarch, confirmed by the Imperial Senate.
Section 4. Independence is maintained, with annual reports submitted to Parliament.
Section 5. The Commission may propose constitutional amendments.


ARTICLE XIV: ACCOUNTABILITY OF PUBLIC OFFICERS AND GOVERNMENT

Section 1. Public officers are accountable and serve with integrity.
Section 2. A Commission on Audit, National Anti-Corruption Commission, and the Office of the Ombudsman investigate and prosecute government officials.
Section 3. Parliament and the public hold the power to impeach.


ARTICLE XV: NATIONAL ECONOMY AND PATRIMONY

Section 1. The state pursues a national economy for the general welfare and sustainable development.
Section 2. Natural resources are state-owned, benefiting present and future generations.
Section 3. The state regulates foreign investments, promoting economic independence.
Section 4. A mixed economy prevents monopolies.
Section 5. Agriculture, marine wealth, and natural resources prioritize rural and marginalized sectors.
Section 6. Agrarian reform ensures land ownership equity.
Section 7. Science, technology, arts, culture, and sports enhance productivity and competitiveness.
Section 8. The right to a balanced and healthful ecology is protected.


ARTICLE XVI: SOCIAL JUSTICE AND HUMAN RIGHTS

Section 1. The state promotes social justice, equality, and well-being.
Section 2. Social justice principles address economic disparities and uplift marginalized sectors.
Section 3. Discrimination is prohibited, and equality before the law is ensured.
Section 4. Every citizen has the right to work, humane working conditions, and protection against unjust dismissal.
Section 5. Labor policies uphold workers' rights.
Section 6. Adequate social services, education, healthcare, and housing enhance citizens' quality of life.
Section 7. Education accessibility is ensured.
Section 8. The right to health is protected, with preventive healthcare measures.
Section 9. Indigenous cultural communities' rights are recognized and protected.
Section 10. Freedom of speech, expression, and peaceful assembly are safeguarded.
Section 11. Human rights are protected, ensuring due process, fair trial, and prohibition of torture.
Section 12. Rights of persons accused of crimes are guaranteed.
Section 13. Women's, children's, elderly's, and disabled persons' rights are upheld.
Section 14. The right to a balanced and healthful ecology is protected.
Section 15. The right to privacy is upheld.

Section 16. The freedom of the press are guaranteed and safeguarded

 


ARTICLE XVII: EDUCATION, SCIENCE AND TECHNOLOGY, ARTS, CULTURE, AND SPORTS

Section 1. The state ensures the right to quality education for every citizen.
Section 2. Education prioritizes critical thinking, creativity, and ethical values.
Section 3. A complete and integrated education system is established.
Section 4. Science and technology are promoted for national progress and environmental sustainability.
Section 5. Arts, culture, and sports are actively promoted for national identity and social cohesion.
Section 6. Cultural diversity is recognized and protected.
Section 7. Citizens are encouraged to participate in cultural and sports endeavors.
Section 8. The state supports and regulates sports activities.
Section 9. Investment in cultural and sports facilities is ensured.


ARTICLE XVIII: FAMILY

Section 1. The state recognizes and protects the family as the fundamental unit of society.
Section 2. Marriage is safeguarded, ensuring equal rights for spouses.
Section 3. Parents have the natural right and duty to care for and guide their children.
Section 4. Family members are ensured mutual respect and support.
Section 5. Children's rights are protected from abuse and violence.
Section 6. Assistance is provided to families facing challenges.
Section 7. Responsible parenthood is promoted, with family planning access.
Section 8. Families are encouraged to contribute to community and nation-building.
Section 9. Rights and dignity of elderly family members are upheld.
Section 10. Policies and programs strengthen family ties and values.

 

ARTICLE XIX: MILITIA

The Holy Elysian Empire upholds a well-regulated militia composed of able-bodied citizens, under state authority, to ensure national defense and security in emergencies, with Parliament having the authority to enact laws governing its organization and utilization. The militia operates in coordination with the regular armed forces, emphasizing adherence to democratic principles, human rights, and international law. Its role includes domestic support and, when necessary, participation in foreign conflicts guided by just war principles.


ARTICLE XX: GENERAL PROVISIONS

This Constitution is the supreme law of the Holy Elysian Empire, and all laws inconsistent with it are void.

 

ARTICLE XXI : AMENDMENTS AND REVISIONS

Amendments may be proposed by Parliament or citizen-initiated referendum, subject to majority voter approval.

 

ARTICLE XXII: TRANSITORY PROVISIONS

Existing laws and government structures remain until modified or repealed in accordance with this Constitution.
