Citizenship in the Holy Elysian Empire is regulated by the 1797 Constitution and laws. The Empire recognizes two primary categories of citizenship: Elysian citizenship by birth and Elysian citizenship by naturalization.
I. Elysian Citizenship by Birth
Jus Sanguinis: Elysian citizenship is primarily determined by blood (jus sanguinis). A person is considered a natural-born Elysian citizen if either of their parents is an Elysian citizen at the time of their birth.
Jus Soli: The Holy Elysian Empire also recognizes citizenship based on place of birth (jus soli). If a person is born in Elysia and neither parent is a foreigner, the child is considered a natural-born Elysian citizen.
Children born to Elysian parents, whether in the Holy Elysian Empire or abroad, are generally considered Elysian citizens. The government recognizes the principle of descent.
II. Dual Citizenship
Elysia allows dual citizenship. This means that a person may be a citizen of both the Holy Elysian Empire and another country simultaneously.
Dual citizenship is typically acquired through birth or through naturalization in another country while maintaining Elysian citizenship.
III. Elysian Citizenship by Naturalization
Foreigners may acquire Elysian citizenship through a legal process known as naturalization. This involves an application process, residency requirements, and demonstrating good moral character. Naturalization is a discretionary grant by the government and is subject to specific conditions outlined in the law.
Requirement:
Residency: An applicant for naturalization must have been a resident of Elysia for 12 years.
Good Moral Character: The applicant must demonstrate good moral character and must not have been convicted of a crime.
Financial Capacity: The applicant should be able to support themselves and their dependents.
Citizenship through Marriage: Foreigners married to Elysian citizens may apply for Elysian citizenship through a process which required a:
Completed application form
Certificate of residence in Elysia
Police clearance from the home country and Elysia
Authenticated birth certificate
Authenticated marriage certificate
Community tax certificate
Affidavit of the applicant expressing their intent to become an Elysian citizen
Statement of assets and liabilities
Three-character references from Elysian citizens
Renunciation: A person acquiring Elysian citizenship by naturalization is generally required to renounce any foreign citizenship they may hold.
IV. Loss and Reacquisition of Citizenship:
Elysians who acquire foreign citizenship may lose their Elysian citizenship. However, there are provisions for the reacquisition of Elysian citizenship under certain circumstances, such as through the Elysian Dual Citizenship Act.
